Hi Ricky,

Yes it becomes a tricky situation. This is in fact a classically asked osce scenario as well. Delirium can be treated under duty of care and should not be treated under the mental health act. The treatment of delirium if requires antipsychotics can be administered as it is in the best interests of the patient and to prevent risk of harm to self and others. The definitve treatment is of course treating the medical cause , but this is not always found.
Going through the guardianship process is good practice.
